Speaker bars ‘rebel’ MPs from Parliament

The Speaker of Parliament has said four MPs expelled by the NRM are barred from participating in any parliamentary activities unless they obtain an order halting a court ruling that declared their presence in the House illegal.

Last week, the Constitutional Court ruled that the presence of MPs Theodore Sekikubo (Lwemiyaga County), Muhammed Nsereko (Kampala Central), Wilfred Niwagaba (Ndorwa East) and Barnabas Tinkasiimire (Buyaga County) in Parliament was nullified when they were dismissed from the NRM party upon whose mandate they were elected.

When the MPs were fired by the NRM last year, Ms Rebecca Kadaga rejected demands by the ruling party to stop them from accessing Parliament, saying such a decision would not be backed by the law. Her decision was challenged by the NRM in the Constitutional Court, resulting into last week’s ruling.

However, Justice Remy Kasule disagreed with his colleagues, solely ruling that the MPs’ continued stay in Parliament was within the law. “This is to inform you members about the orders of the court [in] which I am barred to comply in the absence of a stay of execution. I have notified the four members about the decree and instructed the clerk about those instructions,” Ms Kadaga told Parliament yesterday.

She added: “In the said decree, I was restrained by court from allowing them to continue sitting in Parliament or to take part in any parliamentary activity either in the committees or elsewhere and also to stop payment to them of any salaries or other emoluments and entitlements save for those that they may have accrued to them immediately before the issuance of a court order.”

The four MPs were expelled from the ruling party after the disciplinary committee faulted them for being ‘rebellious’ on account of their resistance to several official NRM sponsored- positions both in and outside Parliament.
