The Lands Commissioner, Ms Sarah Kulata, has declined to cancel a land title issued to Meera Investment Limited amid an ongoing court case in which a family is challenging the transaction of the land in Katwe.
In a January 23 letter, Ms Kulata denied the application for cancellation of the land title under the names of the company, arguing that the same was issued upon grant of consent.
“…I would like a clarification from both the lessee (former and current) and the lessor whether thereafter consent was acquired, is imputed, and specifically what the lessor has to say about this issue,” Ms Kulata wrote in response to a request by the late Fredrick Ssebugulu’s family.
The family had requested for cancellation of the entry of Meera Investments Limited on the land for fear of being evicted. It sued their brother, Mr Fred Kabugo, Meera Investments Limited and the Commissioner of Land Registration alleging transfer of their land is subject to court proceedings.
It is alleged that the accused parties forged a lease agreement and consent to transfer as well as intermeddling with the estate of the deceased. Last December, the Land Division of the High Court halted the eviction and any other development on the controversial land until the pending case is determined.
