Court dismisses woman MP case

Mbarara. The High Court in Mbarara has dismissed with costs a case in which the Woman Member of Parliament for Buhweju District, Ms Oliver Koyekyenga, was contesting the declaration of Ms Alison Ayetoranire Byamukama as NRM party flag bearer for the seat.
On November 13, Ms Koyekyenga applied for a temporary injunction restraining Ms Ayetoranire from being nominated for the seat, alleging the election was not free and fair.
Thy case was, however, dismissed on Monday by Justice David Matovu after Ms Koyekyenga (the applicant) or her lawyers failed to show up in court at 9 am, the time scheduled for the hearing.
“This is wasting court’s time. A situation where I find neither the applicant nor her lawyers in court without explanation, I dismiss the case with costs,” ruled Justice Matovu.
Mr Boniface Ngaruye of Ngaruye, Ruhindi and Company Aocates, who represented Ms Ayetoranire, said after the ruling, the actions by the applicant were delaying tactics to deny his client a right to represent her party. He said even though the case was to be argued to its logical conclusion, the applicant would have lost because it lacked merit.
Ms Koyekyenga said she was in consultation with her lawyers on the next course of action.
